2. Appraisal and Approval of the plan for renovating and rehabilitating the environment in the activities of exploiting mineral
(In case of EIA report , follow the process of EIA appraisal )
2.1. Steps:
- Step 1: Organizations and individuals build up  their dossier for appraising  and approving the plan for renovating and rehabilitating the environment , directly adding documents or sending by post at one-stop shop of the Department of Natural Resources and Environment.
The one-stop shop officer  receives and writes a receipt note, registers, up-dates in file for supervision, then sends it to the environmental protection Bureau for legal processing.
- Step 2: The environmental protection Bureau will get the advice, check the completeness and validity of the dossier. If the dossier is not eligible and invalid within 3-working day limit f-rom the day the dossier is received, The Department of Natural Resources and Environment send a notification for the establishment owner for completion as required.
- Step 3: Within 2-working day limit f-rom the reception of the fully valid dossier, the environmental protection Bureau consult with the Department Leader for a statement submitted to Provincial People’s Committee (through the Provincial People’s Committee Office) and found a council of Appraisers for added project/project.
- Step  4: Within 3-working day limit f-rom the reception of the statement and the dossier that The Department of Natural Resources and Environment has submitted, the Provincial People’s Committee Office advise the Provincial People’s Committee to reach the decision on founding a council of Appraisers.
- Step 5: Within 12-working day limit f-rom the decision on founding a council of Appraisers, the Head of the council is to complete appraising the project/added project.
- Step 6: Within 2-working day limit f-rom getting the appraisal result, the Department of Natural Resources and Environment send a written appraisal result to the organizations/individuals.
- Step 7: If the project goes through without any edition or addition, within 2-working day limit f-rom the appraising day, the Department of Natural Resources and Environment asks the Provincial People’s Committee for approval and at the same time ask organizations/individuals to submit the appraised dossier to one-stop shop of the Department of Natural Resources and Environment.
- If the project goes through after some required edition or addition, within 30-working day limit f-rom the day of returning appraising result, organizations/individuals are to do the edition and addition to the dossier for completion and then submit it to one-stop shop of the Department of Natural Resources and Environment. In excess of the time limit, the council of Appraisers allows the Department of Natural Resources and Environment to make a decision on annulling the appraisal result.
- If the project doesn’t go through or the appraisal result is annulled, organizations/individuals rebuild the project/added project as required.
- Step 8: Within 3-working day limit f-rom getting the edited and added dossier according to the appraisal result, the Department of Natural Resources and Environment complete the dossier, submit to the Provincial People’s Committee for approval of the added project.
- Step 9: Within 3-working day limit f-rom getting the fully valid dossier f-rom the Department of Natural Resources and Environment, the Provincial People’s Committee consider it and approve as stipulated.
- Step  10: Within 2-working day limit after getting the approval decision , the environmental protection Bureau advise the department leader to certify as true on the extra cover of the approved added project and the send the approval decision enclosed with the added project book to the one-stop shop of the Department to pass 01 set to the organizations/individuals and the People’s Committee of District whe-re the project is carried out; send the approval decision to the People’s Committee of Commune whe-re the project is carried out; store 01 original at the Department of Natural Resources and Environment
- Step 11: Organizations/individuals get to the one-stop shop of the Department of Natural Resources and Environment for the last result as stipulated.
2.2. Implementing methods:
- Directly, at the one-stop shop of the Department of Natural Resources and Environment.
- Send by post to the one-stop shop of the Department of Natural Resources and Environment
2.3. Dossier units, quantity
- Dossier consists of:
1. 01 written proposal (format, appendix 1A)
2. Seven (07) projects  (format, appendix 2) or the added project (format, appendix 4).
3. One (01) report of environment-impact assessment or a commitment of environment protection, or a register of environment standards or a simple project of environment protection or an approved and verified detailed project of environment protection
4. A copy of the project enclosed with the Approved decision, in case of an added project
- Quantity: 01 (set).
2.4. Deadline
          - 24 working days upon the receipt of legal documents, of which the Department of Natural Resources and Environment deal with it within 18 days, the Provincial People’s Committee do it within 6 days, in case of a fully valid dossier
          - 57 working days upon the receipt of legal documents, of which the Department of Natural Resources and Environment deal with it within 21 days, the Provincial People’s Committee do it within 6 days, individuals/organizations  edit, add within 30 days, in case of an invalid dossier.

Chapter II. SOLUTIONS TO  ENVIRONMENTAL REMEDIATION
I. Choosing solutions to environmental remediation
- Basing on the factual conditions of every kind of mineral extraction, the effects of mining process on the environment and communities around as well as on the geologic structure, miner composition and environmental quality of the area, organizations and individuals have to build possible solutions for environmental remediation. Solutions for environmental remediation must ensure no incidents to the environment and public health.
- Environmental remediation must follow the instructions at Appendix No. 3 issued with this circular and the regulations involved.
- Describe briefly the solutions; what to do and how much work to do. Make the complete territory map of exploited space and show the work for environmental remediation.
- Assess the effects on the environment, the sustainability and safety of the work for environmental remediation (including depression, devolving, waterproof ness, lowering the underground water level, fractures, environmental incidents, ...).
- Calculate the “soil recovery index" for solution choices (Minimum 02 solutions for each item) defined by the following expression:
I_p = (G_m - G_p)/G_c
In which:
+ G_m: The value the land after recovery forecasted in market prices at the time of calculating;
+ G_p: The total cost of soil recovery to achieve the using purpose;
+ G_c: The primitive  value of the land before the mine opening at the time of calculating (according to the Government’s price);
Choose the best solutions to environmental remediation on the basis of assessing and comparing the soil recovery index and strengths as well as weaknesses of the solutions (Minimum 02 solution for each item in the work)
II. Content of environmental remediation
Based on the chosen solutions to environmental remediation, the content, quantity and categories of work items for environmental remediation should be built, specifically:
- Design and calculate the work quantity for environmental remediation according to the guidance in Appendix No. 11 of this circular.
- Design and calculate the work quantity for environmental remediation which can reach the target, and be suitable with factual conditions;
- Design the work to reduce bad impacts, and prevent environmental incidents for each stage in the process of environmental remediation
- Make a table of the work items for environmental remediation; the work quantity to be done in stages and in the whole process of environmental remediation;
- Make a census of devices, machines and materials, soil, green plants used in the process of environmental remediation in each stage and in the whole process of environmental remediation;
- Make plans of prevention and response to incidents in the process of environmental remediation;
The engineering quota to design, construct the work of  buildings environmental remediation are based on the report of research on mining or designing mining facility or the report on environment impact assessments.
III. Plans
Present the map of carrying out the environmental remediation
Present the progress of environmental remediation and plans of monitoring the construction quality.
The organizational plans for auditing the work of environmental remediation to check and confirm to have completed the content of the project of environmental remediation
The solutions to manage, protect the work of environmental remediation after being tested and confirmed.
In the process of mineral extraction, organizations and individuals can use the results of monitoring the environment in the report on environment impact assessments/ The environment protecting commitment form/ the approved environmental protection project.

The amount of money signed for the first time and the next time, the time to sign for the first time and the next time is under the regulation guidance of this circular.

Chapter IV. THE COMMITMENT AND CONCLUSION
I. The commitments of organizations and individuals
The commitments of organizations and individuals about signing fund for environmental remediation; al-ternatives for environmental remediation must obey the rules about general environmental remediation, environmental protection related to the stages of the project. Specifically:
- Commit to the integrity and objectivity when calculating the amount of money to be signed;
- The commitments to sign fund for environmental remediation at the protection of the environment are true as the commitments in the project of environmental remediation.
- Commit to arrange the capital resources to perform;
- Commit to perform and complete the solutions environmental remediation
- Commit to perform the plan of prevention and response to environmental incidents and commitment to compensate and overcome environmental pollution in the case the environmental incidents are caused;
- Commit to turn in Report and check in the right regulations;
- Commit to report about the results of carrying out al-ternates for environmental remediation or al-ternative ones and the results of environment monitoring to the authority who can approve the al-ternates or administration of environmental protection as regulated.
II. Conclusion
Conclude and evaluate the effectiveness of the project of environmental remediation, the rationality of the amount signed in the environmental remediation fund.

Chapter 1. OVERVIEW
1. Project name
State exactly as the names of the project for environmental remediation provided with ratifying Decision. State the original name, new name and the present clearly about the process and legality of the name changing if the name has been changed.
2. Organizations and individuals

1. Expenditure for environmental remediation and the order of signing fund
- For work items of environmental remediation partly confirmed, organizations and individuals exclude these work items with detail explanation when calculating the fund to sign;
- Re-estimate the fund to sign for the work items without finishing confirmation and the ones with changes in solutions, unit price at the time of planning the supplement al-ternative. The cost estimation is similar as prescribed in this circular.
- Total amount of the fund to sign in the supplement al-ternative equals the total amount of the fund to sign for all work items minus the signed amount. The annual fund to sign in the supplement al-ternative is defined as in this circular.
2. Action plans
Divide the action plan each year and stage of environmental remediation, managing and monitoring program while remediating the environment; plans to check and confirm finishing supplement al-ternatives.

Article 4. The Decision of Ratifying environment impact assessment report in project is the basis for authorities to consider and decide the next steps of the project as prescribed in Article 25 in the law on environment protection
Article 5. Project of environmental remediation/ Project of environmental remediation and the mandatory requirements in Article 2 and 3 in this Decision are the basis for the managing government authorities to inspect, check and confirm the fund signing and environmental remediation.
Article 6. Delegate (8) to check and supervise the implementation of environmental protection in the environment impact assessment report; of environmental remediation in the project ratified; and environmental protection in the process of environmental prescribed in this Decision.
Article 7. This Decision shall come into force on its signing date.
