- The Director manages general affairs of the Department and bears responsibility to the provincial Party Committee, People’s Council and People’s Committee for overall activities of the Department of Natural Resources and Environment.
- The Director is directly in charge of:

+ The organization and personnel affairs, assigning tasks to related divisions and units, financial planning, legislation, administrative reform, internal political protection, emulation and rewarding, discipline, inspection, acting as chairman of the Managing Board of the Environment Protection Fund and owner of the department’s account;

 + Land planning, land allocation, land lease, issuance of land use right certificate, signing land use right certificate and ownership of land-attached assets, land lease contract with organizations and decisions authorized by the provincial People’s Committee, handling reclaims related to land allocation, land lease and land acquisition;

+ Acting as Director of the Management Board of the Improved Land Governance and Database (VILG) Project of Bac Giang province;

+ Participating in the steering committees, task force and councils of the province in relavant sectors;

+ Keeping working contact with the Ministry of Natural Resources and Environment, the provincial Party Committee, People’s Council and People’s Committee, other departments, agencies and unions, secretaty and chairperson of the district-level people’s committee in the province;

- Directly managing the division of Financial Planning and division of Land Management. Directing inspection of task implementation of the units he directly manages;

- Directly supervising natural resources and environmental affairs of Bac Giang city.

2. Vice Director: Vu Van Tuong

- Acting as deputy Secretary of the Party Committee of the Department and permanent Vice Director who will run the department when the Director is absent or under authorization. The Vice Director helps the Director to direct and operate some following sectors:

 - Environmental sector, hydrometeorology, climate change; dealing with reclaims and complaints in the sectors he is in charge; supervising and directing implementation of the Directive No 17-CT/TU dated February 27, 2020 of the provincial Standing Party Committee on mobilizing all people to join hands in waste gathering and treatment; participating in administrative cases as a protector of legal rights and benefits of the chairperson of the provincial People’s Committee or being authorized by the chairperson of the provincial People’s Committee for specific cases;

 - Acting as Chairman of the Environmental Impact Assessment Board;

- Participating the steering committees, task force and councils of the province in the sectors assigned by the Director;

- Directly managing the sub-department of Environment Protection and Environment Observation Center; directing inspection of task implementation of the units he directly manages;

- Directly supervising natural resources and environmental affairs of Viet Yen, Yen Dung and Son Dong districts;

 - Doing some other tasks assigned by the Director.

- Acting as standing member of the Party Committee of the Department and Vice Director who helps the Director to direct and operate some following sectors:

- Mineral and water resources; dealing with reclaims and complaints in natural resources and environmental sector (except for complaints in environmental sector and land allocation, land lease, land acquisition and issuance of land use right of organizations); supervising and directing implementation of the Directive No 09/CT-UBND dated 21 April 2020 of the Chairperson of the provincial People’s Committee on strengthening measures to manage exploitation of mineral resources as common construction materials in the province;

 - Participating in monthly dialogues with people of the Chairperson of the provincial People’s Committee and the Delegation of the National Assembly deputies; participating in administrative cases as a protector of legal rights and benefits of the chairperson of the provincial People’s Committee or being authorized by the chairperson of the provincial People’s Committee for specific cases;

 - Participating the steering committees, task force and councils of the province in the sectors assigned by the Director;

- Directly managing the division of Mineral Resources and Inspection Division. Directing inspection of task implementation of the units he directly manages;

- Directly supervising natural resources and environmental affairs of Hiep Hoa, Lang Giang and Luc Nam districts;

 - Doing some other tasks assigned by the Director.

The Vice Director shall bear responsibilities before the Director and in accordance with law for the assigned tasks and duties and help the Director to direct and operate some following sectors:

- Land management including public land management, land acquisition, compensation for land clearance, resettlement; mapping; land concentration and land pricing; information technology and digital transformation; management and issuance of land use right and house ownership to households and individuals; supervising and directing issuance of land use right, house ownership and land-attached assets in accordance with law; supervising and directing post-inspection upon organizations using land and implementation of the Directive No 19-CT/TU of the provincial Standing Party Committee on strengthening inspection and investigation to handle violations in management and use of land in the locality; deal with reclaims and complaints in the sectors he is in charge as assigned by the Director; participating in administrative cases as a protector of legal rights and benefits of the chairperson of the provincial People’s Committee or being authorized by the chairperson of the provincial People’s Committee for specific cases

- Being in charge of administration, regular revenue and expenditure under the state budget estimation allocated to the Office of the Department;

- Acting as the editorial in chief of the department’s website;

- Acting as Vice Director of the Management Board of the Improved Land Governance and Database (VILG) Project of Bac Giang province

- Acting as chief commander of the Military Command of the Department of Natural Resources and Environment;

- Participating the steering committees, task force and councils of the province in the sectors assigned by the Director;

- Directly managing the Office of the Department, Division of Survey, Mapping and Remote Sensing, Land Registration Office, Land Reserve and Development Center and the Natural Resources and Environmental Technical Center; directing inspection of task implementation of the units he directly manages;

- Directly supervising natural resources and environmental affairs of Luc Ngan, Tan Yen and Yen The districts;

- Doing some other tasks assigned by the Director.

  II. DIVISIONS AND UNITS

1. Office of the Department: in charge of the organization and personnel affairs, allocating incoming correspondence to relating divisions and units in the Department, administration, legislation, administrative reform, internal political protection, emulation and rewarding, discipline.

2. Inspection division: in charge of:

- Inspecting and handling legal violations, dealing with reclaims and complaints, combating corruption in natural resources and environment sector in accordance with law and as per assigned and authorized by the provincial People’s Committee;

- Dealing with reclaims and complaints in natural resources and environmental sector (except for complaints in environmental sector and land allocation, land lease, land acquisition and issuance of land use right of organizations)

- Participating in administrative cases as a protector of legal rights and benefits of the chairperson of the provincial People’s Committee or being authorized by the chairperson of the provincial People’s Committee for specific cases

3. Division of Planning and Finance

Advising the Director to submit to the provincial People’s Committee and Chairperson of the provincial People’s Committee with the following contents:

 a) Collaborating with related agencies to make local land planning and the land planning adjustment to submit to the provincial People’s Committee, guiding, supervising and inspecting implementation of the approved land use planning;
b) Conducting appraisal of land use planning by district-level people’s committee to submit for approval by the provincial People’s Committee, supervising and inspecting implementation of the approved land use planning of the district-level people’s committee;

4. Division of Mineral Resources: advising the contents related to water and mineral resources with details as follow:

A. Regarding water resources

a) Making and implementing water resource planning, making basic inspection plans, plans on water resource distribution, recovering polluted water resources, supervising exploitation, use and protection of water resources, preventing and remedying damage caused by water in the river basins within the province;
b) Delineating prohibited and limited zones, underground water exploitation zones, zones in need of artificial underground water recharge and announcement of minimum flow, underground water extraction threshold under authorization, prohibited and temporarily prohibited zones for exploitation of sand, gravel and other river-based minerals, making list of lakes, ponds and swamps prohibited leveling;
c) Building and managing monitoring system against exploitation and use of water resources and discharge of wastewater into water resources in the intra-provincial river basins;

d) Responding and remedying water pollution, monitoring to detect and handle inter-provincial water pollution incidents under authorization, building and managing water source protection corridors and sanitary protection zones of water supply, ensuing water supply in case of drought, shortage of water or water pollution incidents;

đ) Apprasing dossiers for issuance, extension, adjustment, suspendment, retrieval and re-issuance of water resource permit and permitting right transfer to exploit water resources under authorization, collecting water-based charges and fees and collecting fees for granting rights to exploits water resources in accordance with law, guiding registration for exploitation and use of water resources;
e) Conducting basic inspection and supervision of water resources under authorization, making statistics, inventory and record of water resource data in the locality, making report to the Ministry of Natural Resources and Environment about inspection results of water resources, management, exploitation, use and protection of water resources, prevention and solving damages caused by water in the province;

g) Reviewing exploitation and use of water resources and discharges into water resources in the locality, making lists of contaiminated, deteriorated and exhausted water resources;
h) Guiding, supervising and inspecting filling unused wells in accordance with law.
B. Regarding mineral resources

a) Delineating  restricted and temporarily restricted areas for mining activities, delineating areas areas not subject to auction of the mineral exploitation right under authority of the provincial People’s Committee, proposing to the provincial People’s Committee solutions to protect unexploited minerals, making plans and organizing auction of the mineral exploitation right under authority of the provincial People’s Committee after approval;

b) Making plans on mineral survey, exploitation and use of the locality as regulations, timely detecting and reporting the provincial People’s Committee and Ministry of Natural Resources and Environment on the newly detected minerals, appraising dossier for recognizing criteria for calculating mineral deposits, accounting and making inventory of the mineral deposits under authority of the provincial People’s Committee;

c) Appraising dossiers for issuance, extension, revoking or returning of mineral exploration licenses and mineral exploitation licenses, the transfer of the mineral exploration right and mineral exploitation right, dossier for partial return of mineral exploration and exploitation areas, apprasing mine closure plans, aution documentation for auction of the mineral exploitation right decided by the provincial People’s Committee and appraising charge amounts for granting the mineral resources exploitation right under its competence;

d) Apprasing reports on results of mineral exploration for normal construction materials and peat under the authority of the provincial People’s Committee;

đ) Managing, storing and providing information and documentation on mineral exploration for normal construction materials and peat, making statistics and inventory on approved mineral reserves and making periodical reports to the provincial People’s Committee and Ministry of Natural Resources and Environment in accordance with regulations;

e) Making calculation of natural resource taxation for the minerals not subject to natural resource tax or subject to modification of inappropriate natural resource taxation in accordance with regulations.

5. Division of Land Management

The Division is in charge of land allocation, land lease, issuing land use right certificate to organizations, singing land use right certificate, ownership of land-attached assets to organizations, land lease contracts and decisions as authorized by the provincial People’s Committee, handling reclaims related to land allocation and land lease. The Division shall advise the Director to submit to the provincial People’s Committee and Chairperson of the provincial People’s Committee with the following contents:

- Advising the provincial People’s Committee to regulate land allocation quota and residential land recognition for households and individuals, quotas for recognition of residential land use rights for the households who clear land for agricultural production, quotas for allocation of bare land, bare hills and land with water surface in the group of unused land for households and individuals, minimum area to be divided and other contents according to the Land Law;

- Appraising dossiers for land allocation, land lease, land acquisition, transfer of land use right, house ownership and other land-attached assets in accordance with law, appraising plans on compensation and resettlement support under authorization, helping Chairperson of the provincial People’s Committee to implement land requisition in accordance with regulations;

- Conducting land and land-attached assets registration and issuance of land use right, house ownership and ownership of land-attached assets, signing land lease contract, compiling, managing and updating cadastrial records for religious organizations and establishments, foreign organizations and individuals and overseas Vietnamese who implement investment projects as per required;

- Building and modifying annual land price lists to submit for regulation by the provincial People’s Committee, making land price maps, dealing with problems related to land prices;

- Determining specific land prices as a basis for collecting land use fees, land lease fees, pricing land use right on equitization of state-owned enterprises and calculating compensation for land acquisition by the State and other cases in accordance with law to submit for dicision by the provincial People’s Committee;
- Collaborating with related agencies to guide, inspect and implement compensation and resettlement support for cases subject to land acquisition in accordance with law.

6. Division of Survey, Mapping and Remote Sensing

A- Regarding survey and mapping
a) Appraising dossiers and requesting Vietnam Department of Survey and Mapping for issuance of survey and mapping license in accordance with law;
b) Managing implementation of survey and mapping activities according to the master plans and plans, advising the provincial People’s Committee to inspect and appraise quality of the survey and mapping works, managing local survey and mapping documentation system, managing security, storage, supply and exploitation of survey and mapping data, managing protection of survey and mapping works in accordance with regulations;
c) Managing and implementing the construction, update, and exploitation of the survey and mapping technical infrastructure in the locality;
d) Monitoring map publication and recommending the state competent agencies to suspend and retrieve maps with errors in national sovereignty, administrative boundaries and name of the locality or map publications with technical errors.
B- Regarding remote sensing
a) Aggregating the demand for use of remote sensing image data and information of the locality, proposing purchase or exchange of remote sensing data in Vietnam and abroad and submitting to Chairperson of the provincial People’s Committee for decision;

 b) Managing, recording, supplementing, updating and publicizing remote sensing data and build local remote sensing database to supply agencies, organizations and individuals in accordance with law.

 7. Sub-Department of Environment Protection

A. In environmental sector
a)Appraising the environmental and bio-diversity indicators in the strategies, master plans, schemes and projects under approval competence of the provincial People’s Committee;
b) Appraising environmental impact assessment reports, environmental protection schemes, projects on establishing natural conservation areas and biodiversity under competence of the provincial People’s Committee; inspecting and verifying implementation of environmental protection projects, the works and measures for environmental protection in the operational phase of the projects with approved environmental impact assessment reports under competence of the provincial People’s Committee in accordance with law, certifiying registration and implementation of environmental protection plans of the projects, production and business plans under its competence;

c) Collaborating with related agencies to work out and adjust biodiversity protection master plan of the locality and implementing the approved master plan, guiding and inspecting biodiversity preservation and protecting species conservation centers under the list of endangered, precious and rare species prioritized for protection excluding plant varieties and livestock breeds in the province, appraising dossier for issuance of biodiversity conservation facility certificate as authorized by the provincial People’s Committee;
d) Issuing and modifying hazardous waste source owner registration book in accordance with law, implementing annual statistics on waste generation and treatment in the locality, supervising and inspecting recovery and treatment of expired products or waste in production and business facilities in accordance with law, appraising, inspecting and verifying implementation of the contents and requirements in environmental rehabilitation and environmental rehabilitation fund in mineral exploitation for the projects under competence of the provincial People’s Committee; guiding and inspecting import of waste under its authorization;

đ) Building and implementing the programs, plans, schemes and projects to prevent, protect, remedy and improve environment, preserve and properly use biodiversfied natural resources as assigned by the provincial People’s Committee;
e) Collecting and appraising data and evidence to define damage on environment, requesting compensation for environmental pollution and deterioration in the locality from 2 districts or more, building and implementing plans to prevent and respond to environmental incidents, building capacity and mobilizing forces to remedy environmental pollution incidents as assigned by the provincial People’s Committee;
g) Making, modifying and supplementing lists of establishments causing serious environmental pollution which must be strictly handled, certifying that the establishments causing serious environmental pollution finishes treatment, inspecting treatment of the establishments causing serious environmental pollution and targeted support from state budget to strictly handle some establishments causing serious environmental pollution in public sector in accordance with law, inspecting environmental protection of trade villages in the province as per regulated;
h) Implementing registration, recognition, issuance and revoke of environmental and biodiversity permits, license and certificate in accordance with law;
i) Summing up and balancing budget demand, appraising annual budget plan and estimates for environmental protection activities of the departments, agencies and district-level people’s committee to send to the Department of Finance for approval by the provincial People’s Committee, collaborating with the Department of Finance to guide and inspect implementation of the approved budget plans and estimates from the environmental services;

k) Paying for environmental services related to biodiversity, environmental compensation and rehabilitation, collecting environmental protection fees and charges, signing fund for environmental improvement and rehabilitation in accordance with law, advising the provincial People’s Committee to manage the provincial Environmental Protection Fund;

l) Building and managing environmental and biodiversity observation system of the locality, implementing observation activities and managing environmental and biodiversity observation data under its authorization,
m) Conducting investigation, statistics, inventory and assessment of biodiversity, evaluating ecological systems, endangered, precious and rare species prioritized for protection (excluding plant varieties and livestock breeds, microbes and fungi) and deteriorated genetic sources, recommending and implementing solutions and models for recovery and sustainable use of biodiversity resources in the province;
n) Guiding, investigating and drawing up the list of invasive alien species; implementing measures to prevent and control invasive alien species, guiding and inspecting management of invasive alien species, receiving and processing information and data of genetically modified organisms and genetically modified products, guiding inspection upon genetic resource management in the province;

o) Collecting, managing, summing up, storing and providing environmental data, building, updating, maintaining and running the provincial environmental information, documentation and database, assessing, forecasting and providing information about impacts of environmental pollution and deterioration on human and organisms, summing up and disseminating environmental information in accordance with law;

p) Collaborating with related agencies in handling environmental issues involving different sectors and provinces and preservation and sustainable exploitation of natural resources and biodiversity.

B- Regarding climate change

a) Developing and updating action plans to fight climate change  of the province and organize the implementation thereof;

b) Implementing tasks and duties assigned to the Department of Natural Resources and Environment in the national strategies, programs and plans on climate change, projects and programs in response to climate changes, inspecting implementation of the targets in the programs, plans and projects on climate change in the locality;

c) Monitoring and assessing impacts of climate change to natural condition, human and socio-economic development to recommend response measures;
d) Guiding implementation of the activities to reduce greenhouse gas conforming to socio-economic conditions of the province, inspecting obedience of the regulations on greenhouse gas inventory and emission reduction.
